Attention Deer Hunters!

A thread was started because of the results of a law suit I filed 3 years ago. I never thought I would file a law suit, I think there are way too many sue happy people in this country, but I changed my mind when my family, and I were affected.

The reason I did it was because I wanted the tree stands and "Safety Harnesses"

OFF THE MARKET!

Now a bit more of the story that some of you already know.

Oct. 15 2005 my family and I went camping/deer hunting at the property that my husband had bought for this purpuse, and to later build on when our kids were out of school. It was just perfect 10 acres, on a small lake, mostly wooded. We built a large shed for storage, and an outhouse. (My step daugther and I insisted on this.) We began mowing and clearing it, made a beautiful camp. My family only lived about 5 miles away, instead of 80 where we lived, so we had lots of family get togethers there around the camp fire. We built a small pier, so my nephew would have to step in the mud to go swimming!





Ok, enough of that. What happened on the 15th is what caused me to later file that suit.

My husband and I had woken up around 2:00 in the morning, and talked till about 4:00. When the alarm went off at 5:30 for him to go hunting, he said he was too sleepy. We went back to sleep until around 9:00. Got up had breakfast, and he decided to go ahead and go. (knowing they would be bedded down and he probably wound't see anything) But, being excited as this was the first time he was able to hunt on his own property...

He promised to be back in camp at 5:00. He took 2 bags of snacks with him, and headed for his tree. My son (15 at the time) went fishing. My daughter and I went to investigate some of the woods we hadn't had time for before. We came back to camp, and I started supper. At 5:00, I said "Tim, its time for supper, where are you?" 5:15: "I am starting to get pissed." 5:30: "I asked my son to go drag his butt out of that tree, I didn't care how much fun he was having." (he was the only one that knew exactly where he was) He came running back to camp screaming "MOM COME!" "MOM COME!" He coudn't say anything else. Of course I knew something was bad wrong, so my brother and I jumped in the truck to go. The kids got there before we did. When I came up over the hill and looked down, I seen my husband hanging from the tree. All I could do was fall to my knees screaming his name. I yelled at the kids to run to the neighbors and call 911. I began walking down the hill, but my brother stopped me. I think I knew then that he was dead, but couldn't accept it.

I'm not sure what your saying.

You want tree stands and harb\nesses ff the market because your husband had an accident?

I'm sorry for you loss.

But should we take ladders and safety harneesses from roofing also.

Do they prevent 100% of accidents?

No..

But they save many, provided they are used correctly.

Sorry Josuha, I knew I would slip up somewhere on this. No, not all tree stands or harnesses. Only the Ole Man Tree stands made from 2001-2007, and the safety harnesses that are just around the chest area. People need to spend the few extra bucks to get the kind that has staps between the legs.



What I failed to mention was, it took them 4 hours to get him out of the tree, because they were investgating weather or not it was indeed and accident, weather he had used everything properly, and what caused him to fall in the first place. The pins in the stand broke! So it was double failure, as his chest harness tore. (he only weighed 145 lbs) BUT, he did everything he was supposed to do.

Again, my question, WHY DID THEY WAIT UNTIL 7 PEOPLE HAD DIED, AND I FILED A LAWSUIT BEFORE THEY RECALLED THEM? They KNEW that the pins were bad. We had testmony from a former employee that they had been told when they started having them made in China, they were junk.

The answer I got was, they were making more money selling them, then what they were paying out in lawsuits.

I'm crying Luvvy.. my heart can't stand knowing what you went through when you saw Tim in that tree.. I did the same thing when my cousin told me my sister had died.. I fell to my knees..

Don't cha just hate it when they know something is defective but they want to hurry and sell them because they've already been produced? That's when you find them at flea markets and dollar stores too so you must be careful when buying something like this type of equipment. You'd be surprised what goes into cars in recalls that people don't pay attention to. I always look up the recalls whenever I buy a car and make sure anything thats on a recall is replaced. It's easy to do. Just look up your vehicle online and type in recall for that vehicle and it will tell you all recalls. You can then take it to any dealer and they should fix it for free if it's within the guidelines. I am so sorry for your loss, this was horrific and tragic. Take care Lost

Luvvy, I know you told us that he had died in a hunting accident, but was afraid to ask anymore. It would have been horrific to see that. I am so sorry . Thank you for sharing with us and for filing the lawsuit.

Luvvy even if only one life was saved because you had the courage to file the lawsuit then you did well. I am very proud of you for having the strength to fight this and I hope that more companies will pay heed when they learn that their equipment is not safe.
