Wanted your attention, sorry. You may be as me, as in you are tired of voting for what you believe is the lesser of two evils, but; here is why I believe McCain was the lesser of two evils. I am convinced the way political campaigns are financed is a cancer to our country. Wouldn't it be great to have free thinkers in place of political clones leading us, as in may be pro life, but; sees the benifits of stem cell research, or pro choice, but; sees the benifit of limiting late term abortion! For DECADES McCain has been fighting hard for campaign finance reform, wanting to trust our judgement, needs and wants, in place of special interests. It is a disease that plagues both parties, and not to pick on just Obama, but; no tort reform in the health care bill, lawyers are the biggest lobby contributing to Obama. Saw a glimmer of hope when McCain and Obama both agreed to public financing for their campains, but, Obama back out when all the money came rolling in. We all have opinions as to how decisions made in Washington effect our country, but; I think the route question is why these decisions are made. Good news for some, or what may be many, as promised to my family and friends I will curb my political obsession. Never had this obsession, probably was like others, paid attention, but; didn't dig deep. However, this past election and current crisis led me to this obsession. When looking deeper into politics and coming to believe how egg heads that never physically labored in their life, do not care about us or our country are suckering hard working people as I was, I became pissed to no end. If you are interested google (unless we ban soft money) and (cold hard facts about lobbying.) Here you may understand why McCain believes as he does, and will see how even Chinese money was funneled into our political system, the times it was caught anyway. Do you believe for one minute the special interests and the lobby lawyers wanted McCain elected! Thanks for reading and caring.

I was always convinced that voting for the lesser of two evils meant you didn't vote for one of the two parties...you voted minor candidates, like Nader, Barry Commoner, and similar others. I use to argue with my father that to participate in evil is to still bear the blood on your hands, even if you were simply cheering on the hangman when the innocent man was lynched.

And part of that evil is that in a mass information society, real information, valuable information, transformative information, is hard to come by. Way too often, disinformation is fed to the public through all sorts of channels, including lobbyists, business associations, and even our own government. Lacking adequate research skills and critical assessment skills, the public picks up the disinformation and runs with it.

Such has been the case for the last several decades concerning tort reform and medical malpractice.

Notice how you focus on the lawyers as bad guys. One of the great motions in American politic, is to constantly put before the body politic how their access to the courts to pursue damages done to them through business practices has been evilly manipulated by lawyers. Always...evil lawyers...sue-happy lawyers...greedy lawyers. And each time the body politic is manipulated to fear the greedy SOBs, we agree to legislation to make it harder and harder for us to sue the SOBs who are actually doing damage to our lives and communties, be it McDonalds with hundereds of lawsuits on hot coffee that predated the mythic suit people so badly understand, or Exxon for Exxon Valdez, or whatever...they get away often, literally, with murder. Damages, murder, while the body politic with painted faces, and war whoops...are being sucked down a vortex fed by their manufactured fear of evil lawyers.

Step back, and ask yourself a fundamental question.

Note how you want to argue that Obama is being manipulated, controlled, influenced, by the evil lawyers. So you see yourself as champion for the little guy...lawyers are manipulating us to sue poor doctors.

But here's the rub.

Since this first started appearing as an issue in the 70s, research has shown over and over, that the issue affecting medical malpractice insurance costs isn't lawsuits...it's the volume of medical malpractice!

Not evil lawyers...but ineffective health care providers!

Each year, tens of thousands of patients are hurt or killed by their health practitioners...more than are hurt and maimed by workplace and automobile accidents. MORE THAN WORKPLACE AND AUTOMOBILE ACCIDENTS!

Not by evil lawyers...but by incompetence at some level by practitioners.

TENS OF THOUSANDS!!!

Now...from a distance...who benefits when you start denying people access to the courts to have professional incompetence compensate those it injures?

Does reducing access and awards, give you any better health care?

Does it give you any greater assurance you won't be damaged by the next incompetent act?

Does focusing on evil lawyers benefit anyone other than incompetent professionals and insurance companies?

Who most benefits by the US mantra of evil lawyers? You? Losing access to the remedy of the courts...you benefit in the smugness of stopping evil?

From wrong limbs amputated, to wrong medication, to two young girls killed when their organ transplants were of the wrong blood type...the most basic and simple of medical procedures to insure first capacity of donor organs. This is the world the medical associations and the insurance companies want you to disregard as important, and do all they can to ensure you don't know about these cases. They lobby like crazy for tort reform, because they know...tens of thousands of cases a year makes for bad business...with lots of justifiable lawsuits possible. "So please Mr. Congressman...don't make us pay very much...we've got a lot we're going to have to pay."

The insurance business model is based on selling to people's fears. They're masters at it. Make you afraid...very afraid...and convince you to cough up the money to assuage your fear I made you feel. Knowing how to sell fear, they sell it everyday in their lobbying Congress and manipulating the American public to fear public health care options and tort reform. They've done exceedingly well as getting you to focus on the evil of government and the evil of lawyers.

But if you're so concerned with the lobbying capacity affecting the President, then really, shouldn't your first concern be the lobbying influence affecting you? If the most powerful person in the world is so subject to being a puppet...imagine how subject we must be as peons to a process we actually know so little about, deluded though we might be to our brilliance and insight.

sorry...I hit 'post' when trying to slide to URL...

Try taking a peek at The Medical Malpractice Myth. It'll certainly undermine the surety one might possess of how nice the world would be without those avaricious lawyers.

I would also add observed that in states, like California, where medical malpractice "reform" has been instituted, the premiums for health providers have increased at close to the same rates as in other states. The insurers, who underwrite malpractice, have gotten into the same mindset as all the others -- it's no longer their job to manage risk, they seek to avoid it.

Hi Bake, I agree with much of what you've said in your blog, though I'm honestly not sure that McCain would have been all that much different. After watching Bush screw up royally, I think I've pretty much realized that we're not going to have real change, or be able to trust a politician until that politician is working for the people. The guys we keep putting in there are working for themselves and the selfish interest of the men behind the curtain, whoever they are.

If we could fix campaign finance reform, an independent individual could be put into office. Once the country gets sick and fed up with the same old status quo, maybe they will be willing to actually get bhind a good independent or one who isn't bought and paid for by the good old boys.

Who knows.. I just keep hoping.
