I saw this headline, and said ahh they are suing her tv show. Then, after reading the story, I started reading the comments Most seemed to think the record companies were coming after her personally, they aren't, it's the producers of the show. I also saw that most of the people have no clue about music licensing or fees. here is the meat part of the story. The lawsuit, filed in U.S. District Court in Nashville, doesn't name DeGeneres specifically. It does, however, allege that the daytime show's producers should have known better than to play the recordings "as sophisticated consumers of music," citing the Copyright Act and state law for pre-1972 recordings.
The show's producers allegedly told label representatives that they don't "roll that way" when asked why they didn't seek licenses to play the music, which, according to the suit, are never granted for use on daytime TV at any price.
The plaintiffs include a raft of the biggest labels in America: Arista, Atlantic, Capitol Records, Motown, Sony Music Entertainment, Virgin Records and Warner Bros. Records. The suit doesn't specify a particular dollar amount in damages.
If you do a little research you find out this didn't come about all of a sudden, it has been an ongoing thing that they have been trying to resolve. The "we don't roll that way" producers would not agree to anything, so the lawsuit was all that could be done.
So a lot of people see no wrong in what they are doing, and are blaming the record companies for being greedy. Well the law is the law, just because you don't like it, doesn't mean you can ignore it. Try telling a cop "yeah I saw the speed limit was 30, but hey I don't roll that way, I'm doing 60" and see what happens. I think alot of people don't realize that when music is being played on tv, radio, streaming audio, in movies, in night clubs, and on juke boxes, there are fees being paid. All the apropriate fees were paid when you bought that cd, which is for private use, and not to be duplicated. If you are playing it in your car, at home for yourself or even having a party no problem, but if you are making money from it, then it's a different story. So many look at the big record companies thinking they get ALL the money, but they don't. Part of it goes to the performers/musicians, publishers, and songwriters. So it's the little guys like me, that have to eat, and pay bills just like you do, that get screwed too when people break the law like this!
Just a note: Ellen just got hired on American Idol, and one of the biggest players there is Sony!

She's had songs played on her show that people totally forgot about. Songs that after hearing, i would download because i liked them. I would say, she has helped keep some of these tunes alive. Some have made money off me due to her show.

Well...Here I am.....One musician....to another!
I dont think people understand how things work in the music industry..and how people get paid....
I dont think they realize how much time..effort and work actually goes into a song...and then all the other time spent to arrange it..and make it happen with the instruments..the band members...the singing...backup vocals...Its alot of work...even though its the best work ever..Its fun...and very rewarding.
I call it..My labor of Love...Cause Im not getting rich..but I love it..
They just dont know...
I hope your kicking butt with your band...

RWR, it's true that They do help in some cases to promote some tunes, but what they do is still illegal! We aren't talking about outrageous fees either. There are set limits that can be charged, and those fees can also be waived. A lot of the time it can be $100 or less, so for all the money that is made per show that is a drop in the bucket. I am an ASCAP member, and write most of my own music, but if I want to say, do a Beatles written song, and release it on a cd, I can put it on 500 cd's for $55. the more you do, the better the fees. So, again what they are doing is against the law. don't want to pay the money, write your own.
