I felt bad for her when she caught all that flak about her stance on gay marriage. She's entitled to her opinion and for anyone to get bent out of shape and ridicule her like that was petty.

They gave her the money....was it a gift? If so...then they don't get their money back. There, case decided.

She's being sued because she took out a loan and refused to repay it, and violated her contract against badmouthing the pageant. Seems simple enough to me. Personal responsibility and all that, y'know?

I think this is nut's...First off, if your going to compete in a beauty pageant...Pageant officials shouldn't lend you money to get your boobs enlarged...It's morally repugnant and sends a horrible message to all of the young ladies who compete in pageants honestly trying to get scholarships and other things.

Charli, they're suing for (1) the money they loaned her, which she has refused to pay back, and (2) the proceeds of a tell-all book she agreed, contractually, never to write.

thats fair enough sweetnapper but they didnt have to broadcast about her boobs all over the show. people in this beauty business make a $hit load of money out of these beautiful girls - its them who insist on women changing their boobs many times. sadly these girls just follow like sheep to the slaughter, cos once they have the taste of fame its hard to let it go. and then they loose themselves... something like this coming out is darnright nasty from those officials, she is still very young.

Should there be a 15 percent restocking fee when the boobs are returned to their rightful owner?

This Pageant,,, is all about big business,,, big money,,, and big ratings. Hence,,, they lend money for contestants to get boob jobs. Now,,, do they lend money for them to attend classes to work on their oral responses? Do they lend money for singing lessons,,, or dancing lessons,,,?

What you have here is a good old fashioned donny-brook? And I have to agree with Napa's point,,, though not his editorilizing,,, that it is going to come down the contracts.

Did she sign a contract to pay back the money? Yes or no.
Were there any provisions of the contract that offered an out? Yes or no.
Did she sign an agreement to not write the book? Yes or no.
Is that agreement still binding if she is tossed out by the pageant? Yes or no.

These are the legal points that need to be decided. Speculating on if it is stealing or theft,,, without the contracts in hand to reveiw,,, is jumping to a conclusion. Inferring that she is a theif without reading the contracts,, just inflamatory bullshit.

It would also be jumping to a conclusion, if we speculated that the pageant had violated her medical privacy. Even though the quote that she had no expectations of privacy once she put on a bikinni and walked out on stage seems idiotic,,, to jump to a conclusion that:

1. boob jobs are individually identifiable health care information and meet the definition of PHI,

and 2. that by funding the boob job, the pageant meets the definition of PAYER, and as such may not release the information without a specific WAIVER,,, not just a general waiver,,,

and that would be a violation of HIPAA regulations, and pageant officials therefore subject to cival and criminal prosecution, is still jumping to a conclusion.

Lost in all of this,,, is the simple fact that all of this was started by a judge who tried to bait her,,, and then went on you-tube to RANT about her answer, rather than just doing the job of judge, marking her down, and not trying to ride on the coat tails of the pageant to pump up his manufactured star-dom. I wonder if the pageant has rules governing the comments that came out of his mouth now.

He did more to harm the pageant than she ever did with her initial response. His comments turned what was just going to be a "bad answer", into a political fight about Gay Marriage. The resulting loss in support for the Pageant, and all pageants, from conservatives,,, and their money,,, is the PRIMARY REASON why the MISS AMERICA pageant selected,,,,

RUSH LIMBAUGH as a judge for the 2010 contest,,, instead of another Fantastic Flaiming Homosexual Blogger,,, more intrested in his own celebrity and attacking anyone who disagreed with him,,, than the good of the pageant or his job as judge.

But it does need mentioning,,, that he was selected by the pageant to drum up more viewers from the younger electronic crowd,, and to ride the Gay is Great sentiment that was popular in the entertainment industry at the time.

I am no more editorializing than anyone else. Aside from her anti-gay stance, has the former Ms. California shown any other "morals"? There are plenty of people who put on the mantle of virtue, mostly to cover their own vices from public view.

The young woman was viciously and slanderously attacked from the moment she honestly stated her religeous beliefs. The attempts to villify her, and to undermine her credibility have been continuous since that time. While this suit is about a loan, its motivation is part of the larger attempt to invalidate her point of view, as well as to intimidate any who would speak out as she did.

And anyone who thinks homosexual activity, such as shoving his fist and forearm up his partner's _ _ s is a basis for normal love and normal marriage is a sicko and pervert, regardless of any smear campaign against those hold moral values. Calling it normal or healthy, verbally, in writing, or in law, does NOT make it helathy or normal!

The gist of it is, (1) she took out a loan and has to repay it and (2) a contract is a contract. If she didn't want to abide by the boilerplate of beauty contests, she's not going to get much sympathy by whining about it afterward. She always had the choice to NOT compete. No-one put a gun to her head and forced her to put on a skimpy bikini, after all.

I feel a bit sorry for the bimbo. First, they asked her an opinion question. She answered. Just didn't give the "right" opinion. As if having an opinion is wrong. He asked, she answered. End of story. Period. I do not think she should have lost anything over that. And who ask's these ladies political/religious questions any way? They are suppose to look good, sing/dance good and not fall over in those stupid mile high heels they wear with the swimsuits. Not think.

Sounds pretty cut and dried to me. Regardless of her opinion and she has a right to have one. She was loaned the money to get a boob job and didn't pay the money back--those who loaned her the money have a right to be mad if not paid back. Also all this claiming she is young--so what!? She knows right from wrong, she is of legal age she should have honored the deal.
