Gregg and I went to a closing down sale yesterday just to have a look around. I can't say the name of the company, but what I can say is that it sells linen and things.

We bought a dual coffee maker. One side was a normal coffee maker, the other was an expresso machine. As I am from Europe, I am quite partial to one now and again.

When we got it home, we followed the instructions to the letter in setting it up.

The expresso machine worked perfectly, but when we tried to work the perculator, nothing happened.
We tried resetting it, turning it on and off, letting it sit for a while before turning it back on and still nothing.

With tax the machine cost just little under $200.00

So this morning Gregg called the store.

"Sorry, it's a closing down sale, no refunds or exchanges."

Gregg went on to explain that it wasnt that we didn't like it, or didn't go with our kitchen colours, it didnt work!

The woman on the phone said there was nothing that the store was prepared to do and told us to contact the manufcturers.

We got on to the manufacturers web site, where there was a list of what to do in any situation where the product was 'unlikely' not to work.
It told us to take the product back to the store with the warranty and reciept.

So we called the store again, who said the same thing. They didnt want anything to do with it.

I looked on a retail advisory site which states that when purchasing the product, the contract of sale is with the store, so to go back to them.

Well we did. and still nothing.

We are having now to try and contact the coffee maker's manufacturer and try to get some joy from them as it is all that is left to us.

I wonder how many other items they are selling that are broken, maybe already brought back to the store before and they are just selling them off.
Yet $200,00 is not a huge bargain, so you'd think for that money you would expect it to at least work!

So for now we have a very pretty $200,00 kitchen ornament.

If theres one thing I hate is being ripped off.

'Tiz unfortunate, no doubt, but it is the risk with taking advantage of bankruptcy sales, closing sales, clearance items, etc. I wouldn't even consider it 'immoral'. They have a bunch of 'junk', and wanna unload it as fast as possible. You're gambling on a good deal...and lost.

It would be nice if they made it clear at point of purchase, though.

Yes.. like having a tag "FAULTY" on it for instance!!!!

Closing down sale or not, you dont charge $200 for something that does not work

It was only $30 off.. thats not a huge discount for something that was faulty.

I agree with you, Charli.....
They shouldn't be selling faulty merchandise, as I am sure they could easily return it to their vendor.
If I did not get some satisfaction from the corporate office on this issue, I'd let them know that I'd be contacting my state attorney general!

Good luck!

That same "un-named" store is closing out in my neighborhood, too. I stopped by, thinking I might find some "bargains". Actually, they normally carry quality merchandise, However, I hardly found any "bargains" at all. Most of the prices were
only 25% off and I decided I needed a bigger bargain to purchase the 500 thread count sheets I wanted for my Queen bed, so I left without buying much of anything.

I later learned that it's possible that it was purchased by a liquidator who raises the price and then knocks off some. Don't know if that's a fact, but it very well might be.

Regarding your malfunctioning coffeemaker, I had the same problem with a suitcase which I paid $100 for (at 1/2 off in another store). When I returned it for exchange.(.I wanted one exactly like it...it was a matched set.) I got the same kind of a run-around from the store and called American Tourister who was not happy with what they heard. They put me in touch with a repair location...I had to go get a box to put the suitcase in to mail it to the location...but, eventually they repaired it so that I cannot see the damage and there was no charge...except my charge for mailing it to them because it was too far away to take it.

I would keep it up with the manufacturer of the product until they come up with a solution...I doubt that you will get any satisfaction from the store. Doesn't a Warranty come with the pot? Fill it out and send it in, immediately...It can't hurt.

Document your headaches,,,
Contact the district manager of the store to get the name of the person who handles the insurance.
File a claim of mental anquish on their product liability coverage because the product was defective, and you are so stressed that you are loosing sleep, and your husband can't get it up.
Merriment insues,,,, new coffee maker soon.

The store you are referring to is closing out everywhere but if you ask when their last day is they say it could be tomorrow or next year..... If the store won't go good on faulty merchandise the manufacturer should. Rant and rave at them for either a replacement or getting it fixed. A small aside....the dual coffee systems commonly have poor drip makers, particularily krups (a good name in coffee systems except their dual ones). Come visit....I'll make you esperesso, cappucino....anything you want....Gregg too....

You already know the way things work here and the retailer
wouldn't have a leg to stand on.

I think I'd have to go in on a real busy Saturday and cause a scene to the point where customers are slowing down buying their magnificent "deals". I bet you'd get some real interested management making good on that "oops" in that instance.......

Charligurl, I love your subtle way of putting things......

I know the place very well and my son was a manager there email me the info on the machine let me see what I can do, perhaps I can get it returned for you. Making no promises but at least talking to a real person might help. I believe that's an American company right? It's not fair for you to have to go through that and usually even though it was on sale if you have the paperwork and it doesn't work they should take it back.I know it has been the policy in the past at the stores here. Anyways, let me know where the manufacturers are etc. and I'll contact them from this end if it's an American store and lets see. Take care Lost
