iam, funny, the first domestic case (battered spouse) was brought to court under...animal abuse since there were no laws in effect at the time

gman - the funny thing is that you would probably get in more trouble for putting the Dog in the trunk than your wife! In Tennessee,, when its real hot, the cops cruse store parking lots looking for animals that were left locked up in the car,, when they find them they take them to the animal shelter, impound the vehicle and charge the owners with cruelty to animals.. its very serous business around here!!
As far as wife beating goes, at one time the cops turned there heads to it because the woman had to press charges for an arrest but 99% of the time would drop them with 24 hours,, In Tennessee, it all changed in the early to mid 80's,, now anyone can and will be arrested and charged for "simple assault" a criminal misdemeanor that carries up to 11 months 29 days in jail and several thousand dollars in fines, for just saying anything physically threatening to another person,, actual physical contact does not have to occur at all.. after someone presses charges the state takes over and prosecutes,, the person who filed the charges is out of the loop and cant drop anything once an arrest is made.. contact with visible injury of a spouse is a "class 3 felony, domestic assault" the state takes over after the arrest too, charges cant be dropped,, it carries 6 to10 years in prison, and huge fines as well, and when the spouse is eventually released they "MUST" complete a long coarse of counseling and anger management classes while under parole or its back to jail.. In Tennessee a "lifetime, order of protection" is automatically issued to the victim.. Its nothing like "a restraining order" where the person can be jailed for contacting the other.. A "lifetime, order of protection" prevents them from being found within so many miles of the other person "for life",,, if they even see the other person out in a bar, store, a joint friends house, or what ever,, they cant make there presents known and are required to turn around and leave at once!! Any kind of assault charge in Tennessee prohibits you from buying a gun, voting, assistance through any state funded programs or state employment,,, and a bunch more stuff!!
