An appeals court says a city ban on selling art supplies to young adults, designed to deter graffiti, is unconstitutional.

The law is intended to limit access to the supplies favored by graffiti artists.

But the Second U.S. Circuit Court of Appeals has ruled the city doesn't have the right to block sales of spray paint, broad tipped markers and etching acid to young adults ages 18 to 21.

The court upheld a federal judge's ruling.

A group of high school and college students sued the city last year.

Hurrah for the courts!

Now if they could only get around to throwing out that kosher food law (again! )

It violates the principle of separation of church and state. It also violates the First Amendment, as it is a law that recognizes an establishment of religion.

The government should not have any role in making sure that rabbis are performing their religious procedures correctly. But that is exactly what the law does.

But that just goes to show how much Sheldon and Spitzer care about the Constitution.

In Commack v. Weiss, the US Court of Appeals for the Second Circuit did find that some provisions of the old New York's Kosher Fraud law "on their face violate the Establishment Clause because they excessively entangle the State of New York with religion and impermissibly advance Orthodox Judaism." And although the Supreme Court refused to hear the case, and denied certiorari, the statute has since been revised addressing the constitutional issues in the old act. Are you aware of issues with regard to the new law, or are you opposed to any food law that addresses kashut or hallel?

The revised law is equally flawed.

Government oversight should be limited to the biological concerns of food products as they relate to safety and content, as in shelf life and labeling of ingredients. The government should NOT stick its nose in the subjective labeling of food items, such as “best coffee,” “low sodium,” or “tastes like homemade.” Actually, the government does restrict terms such as “low sodium,” but I think that’s wrong.

Labeling based on religious procedure, such as “halah,” and “kosher,” is completely subjective labeling and has nothing to do with the biological safety of the product.

So if I say my coffee is the best but it really taste like motor oil, should I be fined for that? What if I say my bread is “made with love”...how can you possibly confirm that? You can’t. You can’t because there is no test you can apply that can validate the claim, just as there is no test you can apply to validate that food is kosher.

The bottom line is that kosher food is kosher for no other reason than some guy simply saying that it’s so. That’s what makes it subjective. That subjective evaluation is based on religion and that’s what puts it outside of government regulation. Every single law that relates to religious preparation of food is on its face unconstitutional.

Who needs the courts? The Long Island Rail Road is delivering the justice.

The father of the 13-year-old boy who was struck and killed by a Long Island Rail Road train in Rego Park expressed love for his son and anger toward the city Saturday.

Ari Kraft and a friend had snuck onto the elevated track area -- accessible via numerous fence openings -- in hopes of drawing graffiti on signal boxes, friends and witnesses said. Ari was hit Friday evening just west of the Forest Hills station.

Bet this kid's father wishes the ban was still on.
