There is a wonderful person here that has gone through some personal hell. They suffered a loss, and filed a lawsuit.
This lawsuit successfully resulted in getting the word out to GET RID OF ANY OL' MAN DEER TREE STANDS.

Any Hunters out there, this IS serious-it could result in injury or death.

Now, I'm going to leave the person's name out until they wish to jump in here, but I got permission to start this. Although tons of money has never mattered to this person, I will just say they were awarded $157 million dollars.(It can be proven with a newspaper article)

You cannot replace a life...so please listen.
And celebrate, that now life can be easier knowing good was done, and I can be adopted! j'k

Altho justice was served replacing a life is impossible and justice could not be done .. but at least they have stopped any more senseless deaths from a defective product ... its both wonderful and sad news to my heart for I would never wish such pain on anyone but now the long fight for justice is at its end and it was wrought with many heartaches hopefully now that will be eased ..

There can never be a price set on a life. A life taken from the loved ones by the misconduct of a manufacturer of an item, or food or anything.

LAFAYETTE, Ind. -- Jurors have awarded a Lafayette woman $157 million in a lawsuit against the makers of a tree stand that malfunctioned, allegedly resulting in her husband's death.

The settlement is the largest single-plaintiff judgment for a wrongful death suit ever awarded in Indiana and believed to be one of the largest in the United States, according to industry publications.

Jurors deliberated for about an hour before reaching the verdict Tuesday in Tippecanoe Superior Court.

the lawsuit was filed in February 2006, about four months after her 42-year-old husband, Timothy , was found hanging from a tree where he had been scouting for deer.

Attorney, Mike Phelps of Greenwood, Ind., and a native of Richmond, said he suggested a $100 million award during closing arguments in the trial. He said he did not know how jurors reached the $157 million amount.

"The verdict for my client is great, that's the primary goal," Phelps said on the phone from the Ken Nunn Law Office in Bloomington, Ind. where he is employed. "The second thing is to make sure that people know to get rid of them (defective tree stands).

"This isn't about hunting," he said. "It's about making sure you're safe, and that no hunting products hurt you while you're there and doing it."

Phelps was born in Richmond and graduated from Centerville High School in 1989. He was a four-sport athlete all four years of high school.

"I was probably busier playing sports than with academics," Phelps said. "If I had to do it again, I would have put more time into academics."

He attended both Indiana University in Bloomington and Capital University Law School in Columbus, Ohio.

The complaint had sought $6,000 for funeral expenses and $1.5 million for lost wages based on what Tim would have earned over 30 years.

No one representing the defendants -- L&L Enterprises of Hattiesburg, Miss., Ol' Man Tree Stands of Jay, Fla., and TSR Inc. of Pace, Fla. -- showed up for the trial.

Tim Carley of Hattiesburg, Miss., who was listed as a registered agent for L&L Enterprises on the online court system, said he was unaware the company had been sued and hadn't been involved with the company for about a year.

TSR Inc. recalled about 9,000 Ol' Man tree stands and about 500 replacement pin sets in 2007 because the locking pins could unexpectedly fall out, resulting in a fall, according to a news release from the U.S. Consumer Product Safety Commission. The recall also was mentioned on the company's answering machine.

"I've worked hard on cases like this all my professional life," Phelps said. "It's nice to know that I've made such a difference for someone."

The more people that read, and spread this message the better. That was my whole reason for filing the suit to begin with. I wanted those things OFF THE MARKET! I succeeded! Although there have since been 2 more deaths (that I am aware of) and it took them 2 years AFTER I filed suit to recall them.

Something the articles I have read do not mention, it was a double failure. His safety harness also failed causing him to hang.

PEOPLE PLEASE DO NOT USE A CHEST HARRNESS! Spend the extra money and get one that has straps between your legs.

Of course there have been some untruths printed, and some nasty comments, thats ok too. If you have any questions, I am more than willing to answer them. Here are some links if you are interested.

As for the money... I may never see a penny, and that is ok. As I said, my reason for doing this was to get them off the market so no family has to go through what mine has. (and still is)

Additional thoughts about my identity. I did post a bulletin to everyone on my friends list begging them to not tell anyone my real name. That no longer matters since the papers got ahold of it, and its in every article, and can be found all over the internet.

Its worth it, to get the word out.

I would also like to thank all of you that seen me through this horrible time of my life. If not for friends like you, I don't think I would have survived the first year afterwards. There wasn't a single time that there wasn't someone online to help me through the sleepless nights, the flash backs, the nightmares, the what ifs...etc. I will never be able to express my gratitude for this site. MODS, you have done a world of good for so many.

I know some people don't and won't ever understand how I could post so much here about my personal life. What they don't know is, I have made so many lifelong friends that I can take anywhere. Yes, there are fake people on here, but the ones I call my friends are REAL. I love you all.

Good for you Luvy.. for pushing it until the defective product was off the market.

I remember when I first met you here...all the grief and anguish you and your kids were going through. I am so happy that you(and hopefully the kids) are in a much better place in time.

I hope you and the kids DO actually see the money come in.. you deserve it more then anyone I can think of!

I couldn't stop Snappy. One, I know too many hunters that hunt for their families food. Two, I wouldn't want anyone to suffer like my family and friends have when I had the power to do something about it. It has been a long haul, but worth it in the long run.

You were so there for me, one of my first friends here, I only hope I can now give you the support you need. You are one in a million, and I am so glad to call you MY FRIEND! As well as the other ladies that have already posted.

Mod, I do know how hard you guys work at keeping our true identities private, and it is much appreciated.
You are right, I am a triple winner! Duvvy has been a real trouper through all of this. The last few months have been hard for us, but we have come through it with flying colors. That is one of the things the people here helped me work through too. The guilt I was having opening my heart again, before this was resolved. Again, I'm not sure I could have done it without him. Thank you Lord for sending him to me.

Nice going on getting this information about these tree stands out to people, Loreli!

And luvvy, I am so sorry you had to go thru all of this experience. I did not know anything as about this, as apparently, I came along in the blogs/forums well after this happened.

Hallelujah, luvvy, for the friendships & bonds you have made thru this site subsequent to your traumatic experience. And thank you for having the guts to follow thru on the matter of the faulty equipment. I think anyone who knows you in the least little bit here knows you did if for safety's sake & not for personal gain.

One other thing... I hope this sends a LOUD message to manufactures who continue to put their products on the market KNOWING they are faulty, and can hurt/kill people. I hope this award speaks volumes that the American people are sick of the greedy Big Wigs, that make more money selling their faulty products than what they have been paying out in law suits. They KNEW there had already been 7 deaths BEFORE Tim!
