Seems some people never think to ask before using things that don't belong to them. Must have something to do with that "entitled" mindset of the self-convinced.
Heart condemns McCain-Palin use of Barracuda
ST. PAUL, Minnesota (CNN) — Blasting through the Republican convention hall is the 1977 hit "Barracuda" by rock band Heart.

It's a shout-out to Sarah Palin. When she played basketball in high school, the soon-to-be Republican vice presidential nominee earned the nickname "Sarah barracuda" for her fierce competitiveness.

Some of her opponents revived the "Sarah barracuda" nickname after she became mayor of her hometown, Wasilla, in 1996, defeating a three-term incumbent.

UPDATE: Ann and Nancy Wilson of Heart said Thursday night that Universal Music Publishing and Sony BMG have sent a cease and desist notice to the McCain-Palin campaign over their use of 'Barracuda.'

"We have asked the Republican campaign publicly not to use our music. We
hope our wishes will be honored," the group said in a statement that said they "condemn" the use of the song at the Republican convention.

Oh the horror of it. How dare they use a 31 year old song by a second rate band at their convention. What's next? Perhaps they will steal the text of someone else's speech & claim it as their own.

Oh the horror of it. How dare they use a 31 year old song by a second rate band at their convention.

Gee, where does it state that if the song is to be played , ever, at a non profit event, whom some of the artists do not approve of, they have any legal say in it?

Big difference if the Republican party makes a soundtrack of the convention featuring all the music they played and makes money selling it which of course, we know they did not

As long as you pay the royalties for performance, you can play a song anywhere you like.

Is "Heart" concerned that they won't get the huge crowds for their concert tours any more? Or that people won't buy their albums?








Uh, does anyone recall when they last had a tour, or when they last had a hit on the charts?

They are on tour and they just played Michigan a couple months ago. Plus VH-1 had a special to salute their music....with Alice In Chains, Gretchen Wilson and others. They don't have a big recording contract anymore as the last time around they got screwed over big time....but they play and release song on the net etc...

Uh, does anyone recall when they last had a tour, or when they last had a hit on the charts?

Somewhere around 35 years ago, in that vicinity anyway.

I wonder how they feel about file sharing and it cutting into their financial windfall which should be taxed of course.

Thank you for the tour information, Legacy, I stand corrected. Here are the venues for the tour -- They'll be on the road until the end of September, so there's still a chance for anyone who wants to hear them to get out there.

Spelling is exactly as I found it on their site. For the price of your ticket, you also get to hear Journey and Cheap Trick.

Considering the number of State Fairs and suburban venues they're appearing at, I'd think a little positive buzz in "the Heartland" wouldn't be unwelcome.

Whether the campaign needs permission to play "Barracuda."

Ann and Nancy Wilson, the frontwomen of the rock band Heart, are demanding that the McCain campaign stop using their 1977 song "Barracuda" at political rallies after the song was played in honor of vice-presidential nominee Sarah Palin on both Wednesday and Thursday nights. Does the McCain campaign have to honor the Wilsons' wishes?

Not if the campaign has the correct license. Like thousands of other songs, "Barracuda" is distributed by the American Society of Composers, Authors, and Publishers, meaning that any entity that is licensed with ASCAP can play a song without getting the artist's explicit permission. This license can be held by a venue, like a club or a sports arena, and apply to all events that take place there. In this case, the Xcel Energy Center in St. Paul, Minn., would be the holder, but a representative tells the Explainer that the venue's ASCAP license applies only to sporting events for the Minnesota Wild and the Minnesota Swarm, the professional hockey and lacrosse teams, respectively; otherwise, it's up to the people who use the premises to get their own. A spokesperson for the Republican Convention said the event did have an ASCAP license separate from the one for sports.

Assuming the licenses were all in order, the Wilson sisters probably don't have much legal recourse. But it would be a much different story if the campaign had used the song in an ad or a promotional video. While an ASCAP license covers the right to perform a song, you need a separate "synchronization license" from the publisher to put the song in an ad. Some artists ask for stipulations in their contracts with publishers that prevent their songs from being used for political advertisements or any other causes they find objectionable. (Neil Diamond, for example, is known to be very reluctant to license his songs for programming that is even vaguely political.)

And exactly how does this demonstrate any aspirations to the bar on my part, and exactly what, in your considered Piled higher and Deeper opinion is wrong with that statement? (Since that was the only statement I made, and thus the only thing I could be "wrong" about.) Please, Vinny, either invest in that reading comprehension course many of us have urged you to, or get someone who understands the written word to interpret for you, as your interpretations rather consistently fail to grasp the message.

You would think after being sued by Jackson Browne, they would be a lot more careful about making sure that material they were using wasn't going to be objected to by the artist, even though in this case Heart doesn't retain the rights to the song, but have asked Sony BMG to ask on their behalf that the McCain camp not use the material any longer. A right, incidentally, Sony BMG and Universal Music Publishing does have. As the holder of performance rights of the recordings, Sony BMG can ask that they not use the material any longer. As owners of the copyright, Universal Music Publishing can ask they not use the published music or lyrics (for instance by another performer, to get around using the Heart version). Nowhere did I suggest that there is any legal recourse at this time other than to stop them from using the material in the future (providing the Chris Wilson report that they did have the appropriate ASCAP license for the venue was correct).

If I actually said what you claim I say as often as you claim, I would be wrong as often as you are.

I wonder how many of the politicians at the convention voted for copyright laws?

The copyright holder has the right to protect their interests. Using a song as if it endorses a position could conceivably injure the copyright holder.

Given that Mickey Mouse has been copyrighted (and/or trademarked) for going on close to sixty years, shrugging off the copyright protection on a 30-year song is hardly germane.
