US Supreme Court awaits response to Berg Writ of Certiorari from Obama, DNC and co-defendants Saturday, 08 November 2008 04:23 administrator
11/07/08 U. S. SUPREME COURT AWAITS RESPONSE TO BERG’S WRIT OF CERTIORARI FROM OBAMA, DNC and Co-DEFENDANTS (Contact information and PDF at end) (Lafayette Hill, Pennsylvania 11/07/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obamas lack of qualifications to serve as President of the United States filed a Writ of Certiorari in the United States Supreme Court on October 30, 2008, requesting review of the United States District Court, Eastern District of Pennsylvania, Judge Surricks Dismissal of Philip J. Bergs lawsuit against Barack H. Obama, Jr., the DNC and the other co-Defendants. Accordingly, the U. S. Supreme Court has set dates in which Barack Obama, the DNC and all co-Defendants are to respond to the Writ, which is on or before December 1, 2008.
Mr. Berg remarked today, I look forward to receiving Defendant Obama’s response to the Writ and am hopeful the U. S. Supreme Court will review Berg v. Obama. I believe Mr. Obama is not a constitutionally-qualified natural-born citizen and is ineligible to assume the office of President of the United States.
Mr. Bergs case, Berg vs. Obama was dismissed from the United States District Court for the Eastern District of Pennsylvania, Docket # 08-cv-4083 for lack of standing. Mr. Berg filed a Writ of Certiorari for review of the case and an injunction to stay the election pending review. Justice Souter denied the injunction. It is expected that the Court will decide whether or not to review Berg v. Obama after the Defendants file their response, and Mr. Berg has replied to the Defendants response. The Defendants’ response is due by December 1st and Mr. Berg’s reply will be submitted thereafter.

This release coincides with this!
The Imam who came forward to assist in the search of Barack Obama’s identity left Kenya secretly last night, and will arrive in the UK this morning. He will meet with a US contact person who will assist him in recording an asylum statement in the UK after handing over the documents that caused the blessing of Obama when he was born and to confirm the origin of the name Hussein.
The man will join relatives in the UK because his life will be in danger if he were to return to Kenya after removing the documents from the Mosque’s archives and taking them out of the country. The man has been informed about the on-going case filed in the US Supreme Court by attorney Philip Berg challenging Barack Obama’s citizenship.
When the man heard that Jerome Corsi was in Kenya a few months ago, he took a decision to try and meet him, but had to travel back to Mombasa from Nairobi on hearing that Corsi had been bundled and taken to the airport on deportation orders.
The Imam is the grandson of the late Imam who blessed Barack Obama when he was born in Mombasa on the 4th of august 1961.
While in the UK, the Imam and the American contact person will visit Amnesty International before handing himself over to the authorities where he will formally deliver his application for asylum. The contact man has arranged so that they get an official from Amnesty international to accompany them to the home office desk where he will inform them on he dangers that will face him if he were to return to Kenya after delivering the documents on Obama.
This may now bring to close the speculations on Obama’s citizenship and the secrecy on where he was born.
API will dispatch a detailed letter in support of the Imam’s - application for asylum and protection - to the UK Home Office Secretary later today. The letter will be made available on the site here, but minus the names of the Imam.

'If' what is suggested is true, then:
1. The candidate was not verified as being eliable to run for election.
2. They knew this and attempted to circumvent the Constitution.
In either case, this is a serious Constitutional issue and has to be addressed and these questions answered beyond a doubt.
We have seen our Constitution circumvented, 'legislated' away and sometimes even ignored by previous administrations.
This has to stop.
And any questions has to be answered truthfully and clearly and apart from 'party' politics for the good of the Republic.

He has the birth documents GH. And the SCOTUS has required Barry and the DNC to answer the writ and post his legal birth records. SCOTUS has requested a response to the writ. They have NOT asked him to "post" his legal birth records. They have, in effect, asked him if there is any reason he shouldn't. Whether he should or should not be required to provide additional documentation beyond whatever may have been provided to date is the first question to be answered. It's a long way yet from "SCOTUS requires Obama to post his BC!"

I don't think arguing over retoric is correct at this time.
'If' there is a question of his citizenship, then it certainly needs to be answered, truthfully and in the light.
This is a serious Constitutional issue.
The American People, regardless of party or beliefs have the right to have this answered without any question regardless of party affiliation.
Further 'if' this is true, we may have people attempting to circumvent our Constitution from the inside of government, knowing he may not have been qualified legally, and brings more serious issues.
I think everyone should wait and see and put away their party bias and concern themselves if our Constitution is being adhered to.

I thought this argument had already been settled....at least by most things I have researched, Hawaii says his birth certificate is genuine. And SOMEONE had to have seen it to let him run.

I am satisfied that Obama was born of an american citizen in Hawaii..
and no evidence that has been presented has changed my mind.. to this fact..
what is cloudy ( to me..) is just who his father is....
but that really is none of my business.....

The right wingnuts shoot themselves in the foot when they say things like "The State of Hawaii will not release his original birth certificate," because that stipulates the State of Hawaii HAS his original birth certificate. Whatever documentation Obama has presented to date for whatever reason in cases where his citizenship was required to be established (i.e. passport application), has sufficed until now, and should be sufficient unless and until there is compelling evidence to believe it is not valid. There has been no such case presented. Of course, even if the Supreme Court fails to return Berg's calls, the U.S. District Court for the Eastern District of Pennsylvania has already weighed in on Berg v. Obama. It dismissed Berg’s case on October 24, despite his pleas that Obama's nominee status will result in "irreparable harm to the Plaintiff and other 'Democratic Americans.'" In its 34 page decision, the court called Berg's case "frivolous and not worthy of discussion." All that Berg's appeal is doing is asking the Supreme Court to review the finding. And the writ will be answered by Obama's legal team saying that the finding of the court was valid and should stand. And Berg will have to show why SCOTUS should hear the case. And I predict that SCOTUS will reject hearing the case.

That's not entirely true.
He may well have had an American birth certificate from Hawaii.
But at that time, Indoneseans could register birth there with an American parent.
The issue here is not his American birth certifcate, but did he/or does he now, hold a duel citizenship?
For a child to go to school in Indonesa, he must be a citizen.
And he did attend the school there.
If he does hold a duel citizenship legally, then he is disqualified.
His college files are also closed from my last look.
If he helf a duel citizenship, then he may have applied for foreign education aid.
This would have been recorded.
I think all Americans have the right to know this paper trail and it to be brought up truthfully and in full light regardless of party.
We have all seen how our Constitution was legislated away, opinionated away and ignored by previous adminstrations.
This has to stop and the truth in full light for all to see.
This is a serious Constitutional issue here and not about partisan politics

If he does hold a duel citizenship legally, then he is disqualified. Where do you get this? If he is a natural born American citizen, that is the only requirement. The Constitution does not say if he is ONLY a natural born American citizen. This has been argued in here and in the courts endlessly. You cannot lose your birthright as a natural born American citizen through the actions of your parents prior to the age of majority. Obama was back in Hawaii by age 10 or so, and has never lived outside the US since then. So, at the age of majority or after, unless he RENOUNCED his American Citizenship, he retains it.
People keep posting this crap of IF he did this, or IF he did that, getting the actual laws' interpretations incorrect anyway, and without a shred of evidence that any of those IFs are the case.
What do you not understand about "His citizenship has been priorly established." and In order to make the demands of making him prove it further, you have to have some evidence to refute what he has already presented. EVIDENCE. Not speculation.

I am surprised that any American would not want to know fully what the paperwork trail is, unless of course, it's simply a 'my man thingy' and does'nt care about our Constitution first and foremost.
I do care.
If he has a duel citizenship, he is disqualifed.
You cannot have citizenship to two countries being the C in C.
I suggest we wait until the evidence is in and then start the retoric.

Read the Constitution..
If he was born in another country and that country filed a certificate of birth, he is a citizen of that country under their laws..
Under U.S. law, he may have registered the birth with Hawai with an American parent..but that would still make him a duel citizen.
If he was adopted, and made a citizen of another country, he is still has duel citizenship.
UNLESS HE REJECTED THAT CITIZENSHIP..which would be on record.
In as far a legal basis, this is unprecidented and we'll have to wait and see as I said.
I will again suggest, that as an American, I'd be more concerned about our Constitution than a man, regardless of his party.
Without the Constitution, it becomes a free for all and we may as well all split up, go our separate ways, trash the Constitution, and become another third world country.
Let's wait and see what evidence they have..
