Olympic swimmer Michael Phelps has made marijuana a popular topic. He was photographed smoking from a bong, lost corporate sponsorships, and was suspended from the sport as a result. But celebrities aren't the only ones thinking about dope.

Some legislators in California have pot on their minds, too. That's because the government of the biggest economy in the United States is facing a massive budget deficit whose pain would be alleviated by decriminalizing marijuana.

I don't have a problem with making it legal.
But, as with alcohol or meds, you should still be charged if OWI.

Good idea, but I don't think the police or highway patrol aren't set up to test folks as easily as they test for alcohol.

Probably not, but there are very telltale signs-odor, smoke, pupils,erratic driving, etc.

Not sure what the answer is there....

The Los Angeles Police Department (LAPD) and the National Highway Traffic Safety Administration (NHTSA) have developed specific procedures for testing drug impairment.

I wish they would legalize it and tax it, would be so much less wasted time for the police who have much worse matters going on.

Blood and/or urine tests seem to work just fine in California for determining DUI cases.

So far the only opponents to making it legal are drug abuse "experts" that claim marijuana is a gate-way drug to other more harmful drugs. I don't know if I agree with that. But I guess there's no way of disputing whether it's true since it may well be for some addicts, or just kids experimenting, that aren't properly educated about drug addiction, or anyone else...I just don't know.

I think it is a splendid idea. Fighting the War on Drugs has not decreased the supply or demand one bit. All it has done is made criminals out of people who have not harmed any person or property. Cocaine and heroin should be legalized as well. That would take the wind out the sails of the Mexican drug lords.

If it's legal, then how are they going to regulate and measurse BMC (Blood-Marijuana Content)? Or MLC, as the case may be (Marijuana Lung Content).

Since pot affects different people in different ways, how are you going to measure what is the limit you can have in your system while driving? Or how are you going to test for that at all? Many people are high as a freaking kite after smoking pot and have absolutely no business getting behind a wheel. They do, anyway, of course, with it being illegal...but imagine a highway full of drugged people, in addition to the drunks, and all the defense attorneys that will get them off on some technicality or another.

Plus, far as I know, there aren't any tests that can show pot content in a person's lungs/bloodstream that are "immediate," so that presents another problem.

I personally cannot stand the stuff; I hated it even when I smoked copious amounts of it "back in the day." LOL...now, though, just being around it, the stench of it, nauseates me.

So I don't care if someone wants to get high sitting around their living room or whatever...but legalizing it means people can smoke it pretty much wherever smoking's allowed. Cigarettes, etc., are bad enough as it is..that's all we need,are barrooms full of pot smoke.

^^^ zero tolerance would work..

Cigarettes, etc., are bad enough as it is..that's all we need,are barrooms full of pot smoke.

California is a "no smoking" in bars state...

legalize it, tax it, clear up the courts for more serious matters

People who want to smoke pot are going to smoke it whether its legal or not.

people are going to drive high whether its legal or not.

Just like alcohol is now.

And in Iowa smoking is banned in nearly every public place except the casinos

( I think anway with the casinos... help me here with that one Lor.... I seldom go to the casinos)

if it is legalized...if anyone is suspected of impaired driving under the influence of pot... they are cited and have to take a drug test...

and if found to be under the influence.. they lose their license for a period of time (to be determined by someone smarter than me...)

What do the former sheriff of San Francisco, a retired Orange County judge, and an assemblyman from S.F. have in common? They all believe that the legalization and taxation of California's so-called largest cash crop could bring in around a billion dollars in tax revenue to the state coffers.

Assemblyman Tom Ammiano introduced a bill on Monday that he considers nothing more than a bit of fiscal common sense, says the SF Weekly who explains that the Marijuana Control, Regulation, and Education Act would:

"Remove all penalties under California law for the cultivation, transportation, sale, purchase, possession, and use of marijuana, natural THC and paraphernalia by persons over the age of 21," "prohibit local and state law enforcement officials from enforcing federal marijuana laws (more on that later)" and establish a fee of $50 an ounce on marijuana on top of whatever pot will cost in a legal future - which legalization advocates say is about half what it costs now. This tax rate figures at about a buck a joint.

Moreover, the Times' Eric Bailey reports that Ammiano claims that legalization would, among other benefits, allow law enforcement to focus on more serious crimes, and protect nature "from the uprooting of environmentally destructive backcountry pot plantations that denude fragile ecosystems."

A toxicologic testing for sobriety check points wouldn't be hard to do. A special breath anaylizer for recreational drugs would be as easy as the ones they have in the military for chemical component testings and as availablity for the exhale analyzers in breath medicatation testing on patients for drug compliance. The devise information can easily be loaded into a USB port for graphic printouts and used in court along with the urine and blood screening lab results.
