Is it a "hundred" days yet??

WASHINGTON – An aide to President Barack Obama is on leave from his White House job after the FBI raided his old District of Columbia government office Thursday, arresting a city employee and a technology consultant on corruption charges, a White House official said.

The charges were lodged against the two men at a federal court hearing as the FBI finished searching the city's technology office, which was led until recently by Obama's new computer chief, Vivek Kundra.

Kundra is on leave from his White House job until further details of the case become known, according to a White House official speaking on condition of anonymity because the official did not want to publicly discuss personnel matters.

At the court hearing, Yusuf Acar, the acting chief security officer in the city's technology office, was ordered held without bond pending a hearing Tuesday. Prosecutors said $70,000 in cash was found during a search of Acar's Washington home and that he posed a serious flight risk.

Technology consultant Sushil Bansal of Dunn Loring, Va., was released but was ordered not to conduct overseas financial transactions or leave the Washington metropolitan area. Bansal is due back in court on April 21, and prosecutors said they were hopeful that a plea agreement could be reached in his case.

Acar worked under Kundra, Obama's pick to coordinate federal computer systems. Obama spokesman Robert Gibbs would not say whether the White House knew the investigation was under way when it named Kundra last week, but called the case "a serious matter."

Mafara Hobson, a spokeswoman for Washington Mayor Adrian Fenty, said she was "very confident" Kundra is not a target of the investigation.

Bansal's lawyer, David Lamb declined to comment. It was not immediately clear who would represent Acar in the case.

Acar, a 40-year-old native of Turkey, had a $127,468-a-year position purchasing the city's computer equipment and lining up contract workers for numerous city agencies, according to court documents.

Authorities say Acar and Bansal, along with others, defrauded the government through a variety of schemes, including billing the city for items that were never delivered and "ghost" contract employees who did not work. The scheme involved Acar approving falsified bills and splitting the money with vendors including Bansal, who submitted them, court documents alleged.

Bansal, a native of India who turns 42 next week, is a former city employee and the founder and chief executive of Advanced Integrated Technologies Corp. The company has offices in Washington and India and did more than $13 million in business with the District of Columbia government in the past five years, according to court documents.

One contract involved providing computer support for the city's Department of Motor Vehicles. The company also was given a contract to upgrade the city's human resources computer records and sold virus detection software to the city.

In August Bansal was named entrepreneur of the year by the Association of Indians in America.

An FBI affidavit supporting the arrest warrants indicates that several other businesses and individuals were involved in the alleged schemes, but the other people are identified only by their initials.

The FBI worked with another employee in the city's technology office, who was in on the scheme and secretly recorded conversations with Acar and Bansal as part of the investigation.

In 2007, federal investigators uncovered a massive embezzlement scheme in the city's tax office.

Men and women dressed in suits and wearing latex gloves could be seen entering and leaving the glass-enclosed lobby of the Office of the Chief Technology Officer on Thursday afternoon.

Even as the raid was taking place, Kundra was giving a speech at FOSE, an annual government technology expo. Kundra said part of his focus is to change the way the government buys technologies from vendors.

So at this point, some people they worked with are arrested, but the Obama official isn't a suspect or "person of interest"?

Do I have that right?

By the same criteria, most of the Republican senators should have been part of the scandal the last time one of their brethren was arrested...

Or am I missing something?

Mr. Gibbs said the administration was aware that the raid would take place but declined to answer questions about whether the president was confident Mr. Kundra was not involved in the probe.

He said he would not comment on an ongoing investigation. He directed questions to the Justice Department after repeated follow-ups from reporters during his daily briefing, refusing to say whether Mr. Obama was concerned about the investigation.

Mr. Kundra was named by Mr. Obama to the newly created post of chief information officer March 5. He is responsible for directing policy for federal information technology investments and oversight of federal technology spending. The position is not subject to Senate confirmation.

Last month, former Senate Democratic leader Tom Daschle dropped out as health and human services secretary because of his failure to pay taxes. Mr. Obama called the Daschle situation "an embarrassment" for his administration. In addition, Nancy Killefer removed herself from a nomination to be chief performance officer because of her smaller problems with a tax lien on her home.

Five of Mr. Obama's nominees have faced tax problems. The president's choice for chairman of the National Intelligence Council - Charles "Chas" W. Freeman Jr. - withdrew from the post Tuesday, while the stepson of Mr. Obama's nominee for drug czar, Seattle Police Chief Gil Kerlikowske, also was arrested last month for a parole violation and faced misdemeanor marijuana-related drug charges in 2006 and 1998.

Mr. Acar is an information technology security specialist who earns a salary of $127,468 and was hired by the city in 2004, said Mafara Hobson, a spokeswoman for D.C. Mayor Adrian M. Fenty. He is the technology office's acting chief security officer, court documents say.

Mr. Bansal previously worked as a "project manager in D.C. government and implemented its financial system," according to the Web site of his company, Advanced Integrated Technologies Corp.

Mr. Acar was responsible for purchasing software and hardware, as well as securing contract employees for various city agencies.

The documents say one facet of the scheme involved placing an order for goods from a vendor such as Mr. Bansal's company, which would then order a lower number from the distributor but bill the agency for the full amount.

"An OCTO official, such as Yusuf Acar, falsely certifies that the greater quantity was actually received and the vendor bills the District of Columbia government for the greater amount and is paid accordingly," the documents state. "The co-conspirators then split the proceeds of the crime."

The suspects also conspired to bill the city for nonexistent work by "ghost" employees of a vendor under contract with the D.C. office, according to the documents.

"However, these ghost employees never actually perform any work under the contract," the documents say.

Mr. Bansal's company was founded in April 2003, and was awarded at least four contracts worth more than $700,000 with the D.C. government that covered periods from 2007 to this year, including four with the D.C. information technology office for services that included working with the city's human resources software, according to city records.

The city also awarded a contract from July 2008 to 2009 worth up to $10 million to Mr. Bansal's company for information technology services, equipment and software. Under the contract, the company could be paid no more than $10 million for its work, but does not necessarily mean they earned that amount.

Mr. Acar was ordered held without bond Thursday, while Mr. Bansal was released on his own recognizance.

In 2007, officials discovered a roughly $50 million embezzlement scandal in the D.C. Office of Tax and Revenue.

I have no personal opinion of all this yet, for it's part of the ongoing FBI countrywide fraud investigation. It's not about Republicans or Democrats or Independants or Greens or Constitutionals. It's about crime in the "whole" government and the public can get effected by these embezzlements and corruptions when it comes to their money, businesses and their personal lives.

Our government works with the software and databases that these IT people create for many federal and state agencies. So to be partisan over this case is only instigating division that is not even implimented in this investigation.

Well thats smart. Attack the messenger instead of debate the issue. Or for what I have seen, pretend its not an important issue. I think crime in our government needs to be dealt with. The more information that gets out,the more politicians will be worried about pulling scams. And that goes for democrats and republicans. Thank you for the information, Angel.

Here's another update on this:

Exactly a week after President Barack Obama [Images] formally nominated him as the White House Chief Information Officer, Vivek Kundra, 34, has gone on indefinite leave after his former Office of the Chief Technology Officer of the District of Columbia was raided by the FBI in a sting operation that involved alleged bribery, fraud, and money laundering and resulted in the arrest of two individuals, including an Indian entrepreneur.
Sources said that Kundra is not implicated in the alleged conspiracy or under investigation, but administration sources told Rediff India Abroad that Kundra was "on leave from his White House job (where he began work last week after serving as a consultant to the Obama transition team) "until further details of the case become known and the investigation completed".

White House spokesman Robert Gibbs and DC Mayor Adrian Fenty's office acknowledged that the FBI had informed them before the raid took place, but Gibbs, asked for a reaction referred all questions to the Department of Justice in which the FBI is housed.

Asked if the President had talked to Kundra in the wake of the FBI raid of his former office and if he were confident that he is not involved in this alleged conspiracy in any way, the spokesman said, "As you know, this is an ongoing investigation and the questions about the investigation, I would point you to the Department of Justice."

But, on being pressed, Gibbs acknowledged, "Obviously, it's a serious matter."

Asked if the White House had any concerns about Kundra, Gibbs reiterated, "Again, I would (direct) questions about the investigation to the Justice Department."

When reporters persisted and asked him "if there is any change in the way how the White House is trying to look at their appointments and things because of this situation," he shot back, "The answer is no."

The Indian entrepreneur arrested, Sushil Bansal, 41, of Dunn Loring, Virginia, a suburb of DC, is president and CEO of Advanced Integrated Technologies Corporation, whose company over the past five years had received more than $13 million in contracts from the DC government for the purchase of computers and software for its various agencies.

Arrested along with Bansal, was Yusuf Acar, 40, Acting Chief of Security in OCTO, who worked under Kundra and according to the FBI affidavit had ordered purchases from Bansal's firm and even though only half the products and services ordered been delivered, had falsified invoices and paid full price and split the difference with Bansal.

The FBI sting operation that included wiretaps also alleged in his affidavit that Bansal, a former employee of the DC government, had also billed the DC government for 'ghost' employees, who were paid out by Acar, and as a quid pro quo had gotten Bansal to hire his wife as a consultant in his company for an annual salary of over $100,000.

Sources said that the FBI had been helped in conducting the sting by an informant in OCTO, who had been invited to be part of the conspiracy, but instead had called the feds and blown on the whistle on the alleged racket.

Acar, a native of Turkey,who earned $127,000 a year, and Bansal, who is not a US citizen but a H-1B visa holder, were arraigned in DC Federal Court on March 12 afternoon, and Acar was held in jail without bail as he was a flight risk--since he had been heard on the wiretaps saying that he intended to flee to his homeland since he felt the conspiracy would be uncovered.

Bansal was released on his own recognizance. Both were asked to surrender their passports, and Acar had a preliminary hearing on March 17 and Bansal ordered to appear in court on April 21. He was also ordered not to engage in any overseas financial transactions.

Both their homes were raided and computers and other material taken away by FBI agents even as about another dozen FBI agents aided by technical experts executed the search warrant in Kundra's old office after the employees of OCTO who work in the 9th and 10th floor in the building at One Judiciary Square in downtown Northwest Washington were asked to go home for the day.

Sources, continued to maintain that there was no indication as of now that Kundra was involved in any way in the alleged conspiracy or was aware of it, but other sources said that FBI agents had visited his DC condo building to speak to him, but had gone away after being told Kundra was not in.

At the time of the raid, Kundra was delivering a speech in downtown DC at an annual government technology conference and expo, and the topic of his speech was about changing the way government purchases IT goods and services from vendors.

Sources said that several other individuals and businesses were also part of the alleged schemes and had been mentioned in the FBI affidavit, but not by names but identified only by their initials.

According to AITC's website, it had received OCTO contracts on May 7, 2008, June 5, 2008, August 5, 2008, September 9, 2008, and October 3, 2008, and included business from the DC Department of Motor Vehicles, Net Development Support, and Peoplesoft Consulting Support, and also for the purchase of McAfee licenses.

It also said that the Association of Indians in America, Washington, DC Chapter had on August 10, 2008, presented Bansal with the Entrepreneur of the Year Award.

AITC said Bansal was selected for the award "for his outstanding contribution in the field of information technology and to the growth of AITC".

The company said that "the ceremony was attended by over 100 people, including a very senior representative from the Embassy of India in Washington,DC," and at the event Bansal had "emphasized the importance of innovation to run a successful IT company."

But what is scary is this guy Acar, who is here in the U.S. from Turkey on a "work visa"! And working for the U.S. government on the government IT systems!

Mr. Gibbs is very very upset about all this that's going on.

It will be very interesting as how this climaxes and rolls down hill. I'm curious who the squealer is in the OCTO right now...initials, inititals please.

PoPo, what you can't seem to understand is, the Obama appointee isn't a person of interest.

I know, i know. That's expecting a lot for you to understand. You are, after all, the typical neo-con voter: uneducated, below-average intelligence, easily misled, or even a combination of the three. Still, it's not hard to understand: Just because someone you work with is a criminal, it doesn't make you a criminal, too.

Until such time as there is any evidence showing that this appointee was involved, we've got to assume "innocent until proven guilty." Right now, this is just sensationalism, a way for the news agency to generate more interest (and thus, more ad and syndication revenue) by linking the story to someone famous.

...and no, just because Rush Limbaugh said so is not evidence. Evidence would be: an unbiased comparison of all histories of every confirmation hearing, including all participants whether confirmed or withdrawn. You have made the claim, so it falls on you to prove it.

Obama learned his craft as a politician in the most politically criminally corrupt district of the most criminally corrupt state in the nation.

It shouldn't be any surprise that he is closely associated with a lot of shady and corrupt figures. He was (and still is) surrounded by them, and would not have risen through the ranks of Illinois politics without playing ball.

What would be surprise is if he makes it through his term without the dots being connected directly to him.

After yesterday's FBI raid, Obama's new CIO, Vivek Kundra, is suddenly taking "a leave from his position," reports NBC. FBI agents raided Kundra's former office, where he was CTO of the Washington, DC district. Two former employees of Kundra's, information systems security officer Yusuf Acar and Sushil Bansal were arrested in a federal bribery sting. Computerworld's Eric Lundquist also reports that according to the affidavit, the alleged committed crimes are less sophisticated hacking, than traditional scam artistry, including "ghost employees on the payroll, contracts that overbill for what was delivered and a plan to head for parts unknown if the cops start knocking." Either way, this is far from great news for Obama's platform of transparency and innovation.

Buzz is growing among insiders that Vivek Kundra, the chief technology officer of Washington, D.C., is advising President-elect Barack Obama's transition team.

Kundra's portfolio of work appears to complement a goal in Obama's technology agenda to "use cutting-edge technologies to create a new level of transparency, accountability and participation for America's citizens." Of course, Kundra's close proximity to the U.S. Capitol doesn't hurt.

Kundra declined comment Wednesday about his rumored involvement with the Obama administration.

Washington, D.C., Mayor Adrian Fenty appointed Kundra the District of Columbia's CTO in March 2007, and Kundra has quickly made a name for himself as an innovator who is unafraid of new ideas.

Last week, Kundra and Fenty announced winners of the district's Apps for Democracy contest, which challenged participants to design open source applications that integrate data from the D.C. Data Catalog, information that's released in real time by several government agencies. Fenty said last week the contest would save Washington, D.C., millions of dollars in software development costs.

"The greater part here is the democratization of public data, and the engagement of citizens, and the engagement of the private sector to help us drive innovation and leverage the power of technology," Kundra said at last week's Apps for Democracy press conference.

Kundra has also gained recognition for his use of hosted applications like Google Mail and his unique IT portfolio management model that tracks projects like investments in the stock market.

"We use that [stock] data to decide whether to hold on to the project, invest more or kill it -- similar to what portfolios in a private market would do as far as sell, buy or hold," Kundra told Government Technology in July. "That's brought a lot of scrutiny and moved us aggressively in terms of killing projects that won't deliver."

Kundra's focus on efficient spending could be attractive to the Obama administration as it attempts to eliminate waste from the federal budget amid a ballooning $10 trillion national deficit and what many economists expect will be a protracted recession.

It's unknown if Kundra is on the list of candidates for the new position of national chief technology officer, which is prescribed in Obama's technology agenda. Several high-profile names have been floated for the job, including two from Google: Vint Cerf, the company's chief Internet evangelist, and CEO Eric Schmidt.
