A federal judge in Georgia, Judge Clay Land, threw out a lawsuit brought by US Army Captain Connie Rhodes and her attorney Orly Taitz, the mother of the birther movement. Rhodes has refused deployment on the grounds that President Obama is not her commander-in-chief, because he was not a natural born citizen.
Clay, a Republican and appointed to the court by GWB, stated in his ruling:
“[Taitz] has presented no credible evidence and has made no reliable factual allegations to support her unsubstantiated, conclusory allegations and conjecture that President Obama is ineligible to serve as president of the United States.
The ruling continues: “Instead, she uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter.’” In his ruling against Rhodes, he threatened Taitz with legal sanctions if she should bring another frivilous suit to his court ever again. The backbone of Taitz's case, the fraudulent Kenyan birth certificate, was ruled a fraud and because Taitz had indicated that she paid for it, the object of bribery.
Taitz is involved in another suit, this time in California. A judge is expected rule rule on a motion to dismiss the case at a hearing in late October.

I'd prefer that she simply be deployed. One of my best friends, a single mother with four children, is in the process of being deployed. If she has to give up her civilian life for the security of the country, the good Captain should as well.

Send her to jail (10 years should be about right) and take away her children and send them to separate homes in states very far away from each other. Make sure to rub that in so that it will make her feelings even more warmer for the love of Obama.

the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter. Sounds like she'll be lucky if she escapes charges of abuse of her position to spread illegal misinformation, unlawful slander and unqualified defamation of character.
Not to mention disorderly conduct and professional misconduct.
Under US law, might not this completely unsubstantiated tirade of hogwash against her lawfully elected leader under the constitution also be construed as sedition or even as treasonable?
If she's lucky the C in C may also overlook whether she is actually disloyal on other grounds - such as on the basis of the President's ethnic origins - as the rest of her views hold no legal substance whatsoever.

You raise some interesting points. A few facts of Orly Taitz. She is not a natural born American. She was born in Moldova, married an Israeli in Las Vegas and now lives in Orange County, CA. She graduated from dental school, has a real estate license and since getting her law degree and passing the CA bar, she has been involved as either the plaintiff or defendent in 20 cases over the last 9 years. Once case involved suing her son's former Jewish day school after his expulsion for cheating.
In the end, I must give a giant kudos to Gabriel Winant of Salon for describing her as "barking Bessarabian goo". That and the shirt she wore on MSNBC, which made her look like barking Bessarabian goo on her way to a summer stock audition for a minor part in Grease. I can't look at her without hearing the words to "Beauty School Drop-out".

All of the posturing over the conjecture relating to the birthplace of Obama indicates to me that the days of accepting a candidate's word for date and place of birth is over. Clearly each and every time a candidate seeks an elected office that has either age or naturual born citizen requirements, the election laws of each of the several sovereign states must require each and every candidate to provide a certified copy of the candidate's birth certificate when they appear in person before an election authority such as a state Secretary of State, county clerk, city clerk, or board of election commissioners and under the penalties of perjury, sign a declaration of candidacy under oath or affirmation, that they are duly qualified, have on or before the date of election attained the age required by law for the position that they seek, and if being a natural born citizen is a prerequisite, to attest under oath of affirmation to that fact as well.
All such candidate's filings would then be a public document in the state archives of the state of residence of a candidate for election to any public office, which records should be open for inspection at will by the general public and also be provided as a "read only" pdf file on the official web page of the highest election authority of such state.
In such a manner, a candidate for President of the United States would appear in person to file for office to be on the ballot in such state, providing an opportunity for candidates for president and vice president of the United States to campaign in each and every state, ending the days of being an ignored "fly over state" for those jurisdictions which are not rich in electoral college votes when candidates for president and vice president after being nominated at a national political party's convention, then appear in each and every state that they wish to obtain ballot access in the general election, submit certified copies of their birth certificates, and officially file for office to secure ballot access in that particular state.
Part of the "birther" delimma is that Obama has not been forthcomming and has ignored this issue with the other problem that has failed to resolve the issue being that the courts dismissing related lawsuits act upon technicalities and fail to resolve the controversy on the merits of the issues in litigation . Had any judge of the facts conducted a hearing and issued a subpoena to Candidate Obama for him to appear in person with the original certified birth certificate, then with findings of fact in corporated into a dismissal order, the controversary would have been decided on the merits of the issue once and for all.
While the "birthers" have been maligned by the "lefties" simply for being brazen enougjh to even ask the constitutional qualifications question, it is also very much true that Obama has with gross negligence aforethought ignored the question and has ducked and dodged and failed to kill this annoying but reasonable request for him to forthrightly establish his constitutional qualifications to be President of the United States.
Before Obama, American voters were naive enough to accept without inquiry a presidential candidate's qualifications; however that was before "Question Authority" became second to "In God We Trust" as the governing nantional Mantra.

See, the "birther" dilemma is that they won't ACCEPT that Obama didn't ignore this issue when it first came up, and responded by being forthcoming and showing his birth certificate to put an end to this issue. Just because they're in denial doesn't make them anything except... well.. in denial. (They're also kind of pathetic. Poor mindless little creatures.)

The birther non-movement gets more comedic as time goes on. Rarely have I encountered a group of people so delusional.
Of course, there are also people who believe that the Holocaust did not happen, deny the global climate change phenomenon, and/or believe that David Hasselhoff is a good musician.

The courts will, after all, overlook the occasional frivolous lawsuit, even when filed by an attorney who can't get basic procedural issues right -- just the cost of doing business. But even a federal judge has a breaking point, and Clay Land appears to have reached his.
Earlier this week, Land dismissed a suit that Taitz had brought on behalf of Army Capt. Connie Rhodes, a surgeon who claimed that she couldn't follow her orders to deploy to Iraq because she's not sure President Obama is eligible, under the Constitution, to hold his current position. At the time, Land warned Taitz that if she filed any more "similarly frivolous ... actions in this Court" she'd face sanctions .
