NEW ORLEANS, Louisiana (CNN) -- Civil rights advocates in eastern Louisiana are calling for a justice of the peace of Tangipahoa Parish to resign after he refused to issue a marriage license to an interracial couple.
"He's an elected public official and one of his duties is to marry people. He doesn't have the right to say he doesn't believe in it," Patricia Morris, president of the NAACP branch of Tangipahoa Parish, located near the Mississippi line, said Thursday.
"If he doesn't do what his position calls for him to do, he should resign from that position."
The demands for Keith Bardwell, justice of the peace for Tangipahoa Parish's 8th Ward, to step down came after he wouldn't issue a marriage license to Beth Humphrey, 30, and her boyfriend, Terence McKay, 32, both of Hammond.
"I was just really shocked, because he's an elected official," Humphrey said. Bardwell didn't immediately return calls from CNN on Thursday.
However, Bardwell told Hammond's Daily Star newspaper that he was concerned for the children who might be born of the relationship and that, in his experience, most interracial marriages don't last.
I'm not a racist," Bardwell told the newspaper. "I do ceremonies for black couples right here in my house. My main concern is for the children."

I think the Judge can kiss his career in public service goodbye after this one (at least that is what should happen).
What will he do next? Refuse to issue a license to a couple with a 15+ year age difference between them?
I'm glad that the couple was still able to marry, and that the Judge is getting negative publicity for his actions.

The supreme court made it's decision in 1967 stating couple's could not be denied marriage due to race. so is he being charged with racist behaviour ?

I blogged about the anniversary of the Loving v. Virginia and of course, the president is the son of an interracial couple. Barack Sr. and Anne Dunham would not have been allowed to marry in many states, although it was legal at the time in Hawaii.
But, I agree, one would think that this kind of thing didn't happen anymore.

I think it is hilarious that marriage licenses used to only be issued for interracial marriage because they were illegal. Since interracial marriage is no longer illegal, there is no need for a license.
The couple should kiss the judge, get together in front of their friends and family and find someone to produce them a pretty marriage certificate that keeps the state out of their contract.

I do not think a justice of the peace is a judge. I think they are more like a notary. I doubt any judge would do this.

so is he being charged with racist behaviour ? You cannot charge someone with racist behavior...the behavior of being racist...isn't illegal in this country...(at least not yet). The violation of someones civil rights under federal statutes is however illegal...I'm sure they will go after him on that part.

The U.S. Supreme Court tossed out any racially based limitations on marriage in the landmark 1967 Loving v. Virginia case. In the unanimous decision, the court said that "Under our Constitution, the freedom to marry, or not marry, a person of another race resides with the individual and cannot be infringed by the state."
When the couple have their first child, the ugly should be made to baptize this child.

They are picked on by white children AND black children. ...We have come a long way.But have a long way to go still While I don't disagree that we have yet to reach the end of a long road that culminates in true color blindness, as far as race goes, I don't think the situation is quite as dire as some people seem to think. We have, indeed, come a long way. The numbers of ignorant fools who don't teach their children not to make fun of other children, for any reason, is a much lower percentage with each succeeding generation, and I am sure in 5-10 years, when this couple's children will be of school age, the onus of social unacceptability will fall more heavily on those picking on their children, rather than the other way around.
If, as this jackass of a J.P. stated, it is about the children, that he is not really racist, and he marries black couples right in his home, just like "regular" folks, why has he not seen that blacks are still disadvantaged (by morons just like him), and thus refused to marry any couple of color? If his rationale really involved the idea that "most mixed marriages don't work," again, why does he marry anybody, since 50% of all marriages end in divorce? And did he miss the section in Biology class on human reproduction, where there was no mention made in any textbook I am aware of, that a marriage license is a requisite part of the reproductive process to begin with?

Not everybody hates him. I love him. He did not deny the couple marriage. He referred them to someone who did not have qualms about issuing the license and marrying them. If one has the power to grant permission, one should also have the power to refuse to grant it.
Why are these adults asking permission anyway? They are acting like little children. They deserve to be told no.
